Under the terms of the settlement, the Gulf Coast has been divided into four distinct economic loss zones. The zones are zones A-D, as denoted in the map below.

What must I prove to recover monetary damages for my business?

Zone A: No causation required for any type of business. Only required to prove actual financial loss in 2010.

Zone B: Businesses that meet the Tourism definition or Seafood Industry definition do not need to prove causation. Causation required for all other businesses.

Zone C: Businesses that meet the Seafood Industry definition do not need to prove causation. All other businesses, including those that meet the Tourism definition, must prove causation.

Zone D: Causation must be proved by all businesses.

What is a Risk Transfer Premium ("RTP")?

A Risk Transfer Premium ("RTP") is a factor which is multiplied by your provable financial losses and results in additional compensation for your claim. The RTP applicable to your business is determined by the industry classification of your business and the location of your business.
